General Terms and Conditions

1.Object
The advertising order includes the conclusion of a contract between a company or other advertiser and Media Professional GmbH for the purpose of publishing adverts in Polo Luxury & Country Life magazine.

2.Booking/Cancellation
The customer receives a written order confirmation for his booking. He has the right to cancel the order in writing within 10 days. After expiry of the cancellation period, the booking is binding. Postponements of the booked  advertisements always require written confirmation from Media Professional GmbH; without this, the advertisements and issues booked in the order confirmation are considered legally binding.

3.Advertisement content
The client bears sole responsibility for the content and legal admissibility of his advertisement. Advertisements with illegal or discriminatory content will not be published. Media Professional GmbH is not obliged to check the advert to see whether it infringes the rights of third parties.

4.Data delivery
The advertiser is responsible for the timely delivery of flawless print data. The advertising deadlines are 1 month before publication of the booked magazine. If the advertisement is not delivered, the publisher will automatically republish the last of the advertisements already published. If there is no existing advertisement template that could be published, the publisher reserves the right to charge the full amount of the space reserved for the advertisement. If the client chooses not to enclose a proof with his advertisement, the agency cannot accept any liability for colour accuracy. 

5.Bonuses
Additional services of any kind that are granted as bonuses for annual orders or special multiple bookings must be agreed in writing. They are bound without exception to the fulfilment of the entire booking order. An advance withdrawal of the bonus before the complete placement of all associated adverts may be granted in individual cases. If the customer fails to place the remaining volume of adverts within the period specified in the order confirmation after the bonus has been withdrawn in advance, Media Professional shall be entitled to invoice the customer for the bonus benefits granted up to the amount of the adverts not yet placed (plus VAT).

6.Payment
Invoices must be paid within the payment period stated on the invoice. Media Professional GmbH reserves the right to demand advance payment before fulfilment of the advertising order in special cases.

7.Reminder charges/collection
In the event of late payment, a reminder fee of CHF 20 per reminder will be charged. In the event of non-payment, 10% interest on arrears will be charged from the date of  default. If payment, including reminder and enforcement charges, is not made after the 3rd reminder, a debt collection agency will be called in. The costs for this shall be borne in full by the non-paying customer.

8.Special features
All agreements deviating from the general terms and conditions require written confirmation from the agency.

9.Force majeure
If the magazine does not appear due to force majeure, the customer cannot derive any claims for damages from this.

10. Place of jurisdiction
Swiss law shall apply. The place of fulfilment and jurisdiction is the registered office of Media Professional GmbH, unless other legal regulations apply.
